Proposeed Submission Local Plan for its Regulation 19
Before the Local Plan is submitted for examination by a Planning Inspector, Regulation 19 of the Town and Country Planning (Local Planning) (England) Regulations 2012 requires that the plan be published to allow for representation on the plan to be made. The Inspector will consider all representation made during this consultation. The Inspector will consider whether the Council has met the legal requirements and whether it meets the tests of soundness set out in the national policy (National Planning Policy Framework). Plans are sound if they are:
- Positively prepared – provide a strategy which, as a minimum, seeks to meet the area’s objectively assessed needs; and is informed by agreements with other authorities, so that unmet need from neighbouring areas is accommodated where it is practical to do so and is consistent with achieving sustainable development
- Justified – an appropriate strategy, taking into account the reasonable alternatives, and based on proportionate evidence
- Effective – deliverable over the plan period, and based on effective joint working on cross-boundary strategic matters that have been dealt with rather than deferred, as evidenced by the statement of common grounds; and
- Consistent with national policy – enabling the delivery of sustainable development in accordance with the policies in this Framework and other statements of national planning policy, where relevant.

Alternatively, representation should be made using the representation form available at: Basildon Borough Council Statement of Representation Form, or at your local library or by contacting 01268 533333. The use of the representation form is strongly recommended as this will ensure that comments are relevant to the subsequent examination by a Planning Inspector.

All responses must be received by 11:59pm on 22nd September 2026. Please note that all responses will be published on the Council’s Website.
Section 149 of the Equality Act 2010 requires that the Council should avoid any form of discrimination and foster good relations between different ethnic groups. Comments which are deemed to be discriminatory, racist, inflammatory or derogatory will be considered as inadmissible and will not be accepted.
What happens next?
The Local Plan will be submitted for independent examination (Regulation 22). The Local Development Scheme (LDS) here: Basildon Borough Council Timetable and Consultation Standards sets out the timetable for the adoption of the Local Plan.
All representation will be provided to the Inspector. The Council will produce a summary of the main issues raised in the consultation responses for the Planning Inspector and publish this online. Your name, your comments and any information provided, including supporting documents, will be available for public inspection and published online.
